First 30 days in Miami domicile checklist, desk with paperwork, keys and a plant by a window, Brickell skyline and Biscayne Bay in golden light — moving to Miami, cost of living Miami, moving to Miami from New York, new york vs florida taxes

Short answer: First 30 days in Miami: license, homestead, voter registration — the domicile checklist, in the order that actually protects you. Moving to Miami from New York or another northern state only saves the tax if you can prove the move, and the proof is a dated paper trail you build in the first month: a Florida driver license within 30 days of establishing residency (Class E fee $48), your car titled and registered in Florida with the one-time $225 initial registration fee, a sworn Declaration of Domicile filed with the Miami-Dade Clerk under Florida Statute §222.17 for a $10 recording fee, voter registration in Florida (deadline: 29 days before any election you want to vote in), and — if you bought — a homestead filing worth up to $51,411 off your assessed value in 2026, due by March 1. Miss the order and you can do everything “right” and still hand your old state its best audit argument: a New York license, a New York voter roll and no Florida paper dated anywhere near your move. The cost of living in Miami gets the headlines; this checklist is what keeps the new york vs florida taxes math in your favor.

Moving to Miami: the first-30-days domicile checklist, in order

Do these in this sequence — several items unlock the next one — and keep the dated receipt for every step:

  1. Days 1–10 — Florida insurance, then title and register the car. You need a Florida insurance policy before the Tax Collector can register the car. New residents title and register within days of establishing residency — residency starts when you start a job, enroll a child in public school, register to vote or file for homestead, not when the moving truck arrives. Budget the one-time $225 initial registration fee (§320.072) on top of title and plate fees; county tax collectors estimate about $420 all-in to title and register an out-of-state car for the first time, plus any use tax if you bought it within the last six months.
  2. Days 1–30 — Surrender the old license, get the Florida license. Florida expects a Florida driver license within 30 days of establishing residency. You surrender the out-of-state license at the same visit — that surrender is itself domicile evidence — and you will need proof of identity, your Social Security number and two proofs of Florida residential address. Class E fee: $48. With a valid out-of-state license, the written and driving tests are normally waived; vision screening is not.
  3. Same visit — register to vote in Florida. The license office offers voter registration on the spot. Florida’s deadline is 29 days before an election (the Division of Elections calls it “book closing”; for the November 3, 2026 general election it was October 5, 2026). Then cancel your registration in your former state — the Florida Division of Elections itself tells new Floridians to contact their old election office and cancel. Still being on the New York voter roll two years after your “move” is the kind of detail auditors quote back to you.
  4. Week 2–4 — File the Declaration of Domicile. Under Florida Statute §222.17, you file a sworn statement with the Clerk of the Circuit Court in Miami-Dade declaring that your Florida home is your permanent, predominant home, listing where you used to live and any other home you keep. It is optional, notarized, takes one trip, and the recording fee is $10. In exchange you get the single most precisely dated piece of domicile evidence Florida offers — and §196.015 lists a recorded declaration as the first factor property appraisers weigh when deciding whether your residence is really your permanent home.
  5. If you bought — calendar homestead now, file by March 1. Homestead is not a 30-day deadline; it is a January 1 / March 1 trap (next section). What belongs in the first 30 days is the calendar entry and the evidence file: deed, Florida license, voter card, vehicle registration — the appraiser will ask for exactly this cluster.
  6. Throughout — start the day count and the paper trail. Keep a contemporaneous log of where you sleep, move your bank, doctors, subscriptions and “near and dear” items to Florida, and file a part-year return in your old state for the year of the move. Domicile is proven by conduct over time; the first 30 days are when the conduct is cheapest to document.

What most people don’t know

Homestead runs on January 1, not on your closing date — and in 2026 it is worth $51,411, not $50,000. To get the exemption for a tax year you must own the home and live in it as your permanent residence on January 1 of that year, and file with the Miami-Dade Property Appraiser by March 1. Buy and move in during October 2026 and your first homestead year is 2027 — file by March 1, 2027. The amount also moved: with the Amendment 5 inflation adjustment, the 2026 exemption takes up to $51,411 off assessed value — the first $25,000 against all taxes including schools, plus up to $26,411 more against non-school taxes. At a combined Miami-Dade millage around 18.5 mills that is roughly $700–$950 in the first year depending on your city (SETTLE estimate) — and the larger prize is what the filing switches on: the Save Our Homes cap, which limits later increases in your assessed value to 3% or CPI, whichever is lower, every year you keep the homestead. One rule with teeth: you cannot claim a residency-based exemption on a home in another state at the same time — cancel the old one.

Doing the paperwork does not, by itself, beat a New York audit — it is one leg of two separate tests. New York can tax you as a resident in two independent ways. The domicile test asks where your life is centered, weighed on five primary factors: your homes, your active business involvement, where you spend time, where the items “near and dear” to you are, and where your close family is. The checklist above speaks directly to that test — which is why the order and the dates matter. But the statutory residency test ignores intent completely: keep a permanent place of abode in New York for substantially the whole year and spend more than 183 days there — any part of a day counts — and you are a New York resident taxed on worldwide income, Florida license or not. How that second test traps people who keep a New York apartment is the subject of our guide to the New York exit audit, and the day-count mechanics are in our 183-day rule guide. This checklist builds the Florida side of the file; those two pages defend the New York side.

Renters are not exempt from the checklist — they need it more. Homestead is the only item above that requires owning. A renter moving to Florida from Illinois or Connecticut builds domicile with the license surrender, the Florida vehicle registration, the voter registration and cancellation up north, the §222.17 declaration (it requires a Florida abode you recognize as your permanent home, not a deed) and a 12-month lease in your name. That file is also what a future landlord, an insurer or a residency auditor will ask for — and it costs about $283 in state and county fees ($48 license + $225 initial registration + $10 declaration) before title and plate charges. Moving to Miami from New York (or NJ, CT, IL, CA): what each deadline really costs if you miss it

StepDeadlineCostWhat missing it costs
Florida vehicle title + registrationFirst days after residency is established$225 initial registration + title/plate fees (~$420 all-in estimate)Driving on the old state’s plates while claiming Florida domicile — a visible contradiction in any audit
Florida driver license (surrender the old one)30 days$48 (Class E)Your strongest single domicile document stays northern; also required as ID for the homestead file
Voter registration in Florida + cancel the old one29 days before the election you want to vote inFreeMissing a whole election cycle — and staying on your old state’s roll as counter-evidence
Declaration of Domicile (§222.17)No deadline — file in the first month$10 recordingNo dated, sworn, public record of when Florida became home; the date is the evidence
Homestead exemption (owners)Own + occupy on Jan 1; file by Mar 1Free to fileA full year with no exemption (~$700–$950) and no Save Our Homes cap clock started

And the honest boundary of this page: it is a checklist, not a tax opinion. If you keep a home, a business or more than a few weeks a year in your old state, the savings at stake — five figures a year at northern incomes — justify one consultation with a Florida tax attorney before the move, not after the audit letter. Everything above is general information drawn from Florida statutes and state agencies, cited below.

Frequently asked questions

Do I have to file a Declaration of Domicile to be a Florida resident? No — it is optional under §222.17, and domicile is ultimately proven by your conduct. But it is the cheapest dated proof available ($10, one notarized page, filed with the Miami-Dade Clerk of the Circuit Court), and Florida law lists it first among the factors property appraisers consider for homestead (§196.015). For a transplant leaving a state that audits departures, “optional” and “skippable” are not the same thing.

I rent in Miami. Can I still establish Florida domicile? Yes. Domicile does not require owning. A 12-month lease, the Florida license (surrendering the old one), Florida vehicle registration, voter registration in Florida with the old registration cancelled, and a §222.17 declaration naming your rented home as your permanent home build a complete renter’s file. Only homestead requires a deed.

I moved to Miami in November. When do I get the homestead exemption? For the following tax year: you must own and occupy the home as your permanent residence on January 1, then file with the Miami-Dade Property Appraiser by March 1 of that year. The 2026 exemption is up to $51,411 of assessed value, and once granted it renews automatically while you stay — and starts your Save Our Homes 3%-or-CPI cap.

Does completing this checklist guarantee New York will stop taxing me? No. It builds the Florida side of your domicile evidence, but New York also applies the statutory residency test: a permanent place of abode kept in New York for substantially the whole year plus more than 183 days spent there makes you a New York resident regardless of intent or paperwork. If that is your situation, read the exit-audit guide linked above and get advice before your first Florida tax year closes.
